Terms of Use

1. Agreement and service operator

These Terms are an agreement between you and AliciaOS LLC, the operator of the Elo-Kin household organization service (“Elo-Kin,” “we,” “us,” or the “Service”). By creating an account, accepting these Terms, or using the Service, you agree to these Terms and acknowledge the Privacy Policy and Health Data and Medical Disclaimer. If you do not agree, do not create an account or use the Service.

If you use Elo-Kin for an organization, you represent that you may bind that organization. Mandatory consumer rights that cannot lawfully be waived remain unaffected.

2. Eligibility and accounts

Independent cloud accounts are for adults who can legally enter this agreement. Children may use only an adult-managed household profile with appropriate parent or guardian involvement. You must provide accurate account information, protect your credentials and profile PINs, and promptly report suspected unauthorized access. You are responsible for activity you authorize through your account and devices.

3. Households, profiles, and authority

Household owners control membership and may assign roles and permissions. You represent that you have a lawful basis and appropriate permission to create a profile for, invite, or enter information about another person. Creating a child profile requires the confirmation described in the Children and Parental Consent Notice. Do not add a person, photograph, health record, school record, journal, or other sensitive information if you do not have authority to do so.

People in the same household may be able to view or change shared content according to their role and the permissions selected by the household. Review those permissions before adding sensitive material.

4. Acceptable use

You may not use Elo-Kin to violate law or another person’s rights; impersonate, threaten, harass, exploit, or stalk; upload unlawful or malicious material; attempt to bypass permissions or access another household; probe or disrupt security; distribute malware; overload the Service; scrape the Service without permission; or use the Service to make automated high-impact decisions about another person. You may not use a child profile to evade age, consent, or supervision requirements.

5. Your content

You retain ownership of content you submit. You give Elo-Kin a limited, nonexclusive license to host, copy, process, transmit, display, back up, and delete that content only as reasonably needed to provide, secure, maintain, and support the Service or comply with law. You are responsible for the accuracy, legality, and appropriateness of your content and for keeping independent copies of records that are important to you.

6. Optional AI Quick Capture

AI Quick Capture is optional and disabled unless enabled for the applicable profile and on the server. When enabled, only text the user deliberately submits through Quick Capture is sent to the configured AI provider to suggest a structured Elo-Kin action. Elo-Kin does not use that feature to scan journals, logs, household history, or unrelated account content. AI output can be incomplete or wrong; review it before saving. Do not submit information you are not authorized to disclose or rely on AI output for medical, legal, financial, safety, or emergency decisions.

7. Health and emergency limitations

Elo-Kin is an organizational tool, not a healthcare provider, medical device, emergency service, or substitute for professional advice. It does not diagnose, prescribe, monitor emergencies, or guarantee that reminders will arrive. Call 911 or the appropriate local emergency number when urgent help may be needed. The Health Data and Medical Disclaimer is part of these Terms.

8. Notifications, backups, and availability

Notifications depend on device, browser, network, operating-system, and provider settings and may be late or absent. Backups, archives, recovery features, and exports reduce risk but cannot guarantee recovery. Keep an independent export of important information. We may change, suspend, maintain, or discontinue features and may impose reasonable technical limits to protect security, performance, or other users.

9. Service changes and beta status

Elo-Kin may be offered as a beta service. Beta features may change and may contain defects. If paid services are introduced, price and renewal terms will be presented before a charge. We may update these Terms; material changes will be identified by a new version and may require renewed acceptance. Continued use after a non-material update becomes effective constitutes acceptance where permitted by law.

10. Suspension and termination

We may restrict or suspend access when reasonably necessary to investigate a security incident, protect people or data, comply with law, address nonpayment for a future paid service, or respond to serious or repeated violations. We will use reasonable efforts to provide notice when circumstances permit. You may stop using Elo-Kin, export available data, remove profiles, or schedule account deletion. Scheduled account deletion currently includes a seven-day cancellation period; operational and legal exceptions are described in the retention notice.

11. Intellectual property and feedback

Elo-Kin’s software, branding, design, and original materials are protected by intellectual-property law. These Terms do not transfer them to you. If you voluntarily provide feedback, you allow us to use it without restriction or payment, but we will not treat feedback as permission to publish your personal content.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim warranties that may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant uninterrupted operation, perfect accuracy, delivery of reminders, or recovery of every record. Some jurisdictions do not permit certain disclaimers, so some of this section may not apply to you.

13. Limitation of liability

To the maximum extent permitted by law, Elo-Kin and its operators, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, goodwill, or data, arising from the Service. Any limitation applies only to the extent lawful and does not exclude liability that cannot legally be excluded. Consumer-protection rights remain available.

14. Governing law and disputes

Unless the law where you live requires otherwise, these Terms are governed by Minnesota law and applicable United States federal law, without regard to conflict-of-law rules. Before filing a claim, each party should send a written description and allow 30 days for a good-faith attempt to resolve it. These Terms do not require arbitration or waive a right to participate in a class action.

15. General terms

If a provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer your account or these Terms without our consent; we may assign these Terms as part of a lawful reorganization, financing, or transfer of the Service. These Terms and the documents they incorporate are the entire agreement about the Service, except for any separately signed agreement.
